When you use "GPT Composer" or other services provided by Seamless Ventures Pty Ltd, including our software, tools, developer services, websites, and application programming interface (API), you are bound by these Terms of Use. These Terms encompass our Service Terms, Sharing & Publication Policy, Usage Policies, and any other written documentation, guidelines, or policies provided by us. By using our Services, you agree to abide by these Terms. For information on how we collect and use personal information, please refer to our Privacy Policy. Registration and Access To use the Services, you must be at least 13 years old. If you are under 18, you need parental or legal guardian permission. If you are using the Services on behalf of someone else, you must have the authority to accept these Terms on their behalf. When registering for an account, ensure that the information you provide is accurate and complete. Do not share your access credentials or account with individuals outside your organization, and remember that you are responsible for any activities carried out using your credentials. Usage Requirements (a) Use of Services: You may access and use the Services in accordance with these Terms. It is your responsibility to comply with these Terms and all applicable laws when using the Services. We and our affiliates retain all rights, title, and interest in the Services. (b) Feedback: We appreciate feedback, comments, ideas, proposals, and suggestions for improvement. If you provide any such input, we may use it without any restrictions or compensation to you. (c) Restrictions: The following actions are prohibited: (i) using the Services in a way that infringes upon or violates anyone's rights; (ii) attempting to reverse engineer, decompile, or discover the source code or underlying components of the Services, unless such actions are contrary to applicable law; (iii) using the Services' output to develop competing models against Seamless Ventures Pty Ltd; (iv) except as permitted through the API, employing automated or programmatic methods to extract data or output from the Services, including scraping or web data extraction; (v) misrepresenting the Services' output as human-generated when it is not, or violating our Usage Policies in any other way; (vi) buying, selling, or transferring API keys without our prior consent; or (vii) providing us with any personal information of children under 13 years old or below the applicable age of digital consent. You must comply with any rate limits and other requirements stated in our documentation. The use of the Services is only allowed in geographies currently supported by Seamless Ventures Pty Ltd. (d) Third-Party Services: Any third-party software, services, or products you use in connection with our Services are subject to their own terms, and we are not responsible for those third-party products. Content (a) Your Content: You may input data into the Services ("Input") and receive generated output based on that Input ("Output"). Input and Output together are referred to as "Content." As long as you comply with these Terms, you retain ownership of the Input. Seamless Ventures Pty Ltd assigns to you all its right, title, and interest in and to the Output. This means you can use the Content for any purpose, including commercial purposes like sale or publication, as long as you adhere to these Terms. Seamless Ventures Pty Ltd may utilize the Content to provide and maintain the Services, comply with applicable laws, and enforce our policies. You are responsible for the Content you provide, ensuring that it does not violate any laws or these Terms. (b) Similarity of Content: Due to the nature of machine learning, the generated Output may have similarities with Content generated for other users. Seamless Ventures Pty Ltd does not guarantee that the Output will be entirely original or exclusive to any user. (c) Intellectual Property: All intellectual property rights related to the Services, including any improvements or modifications made to them, belong to Seamless Ventures Pty Ltd. Nothing in these Terms grants you any rights to use Seamless Ventures Pty Ltd's trademarks, logos, or other brand elements. (d) You are responsible for fact-checking your content prior to sharing or distribution. (e) You are responsible for checking the content for plagiarism. If it is plagiarized content, you should delete the content. (f) You are responsible for ensuring the content does not violate any laws including but not limited to copywrite laws. (g) You are responsible for ensuring you only use the website on a secure device that you own. (h) You agree not to use GPT Compose website (software) on a public computer. (i) You understand that GPT Compose website (software) does not store your settings or content on our servers. If you clear your browser cache you may lose any associated data configuration settings. (j) Images created using the GPTComposer.net prompts are not to be used for commercial purposes, non-commercial use only. Termination Seamless Ventures Pty Ltd reserves the right to suspend or terminate your access to the Services if you violate these Terms or engage in any activity that poses a risk to the integrity, security, or availability of the Services. Termination may result in the deletion of your Content. (j) You will not use any of the content for legal or financial advice. (k) GPT Composer may produce inaccurate information about people, places, or facts. Always check the content produced for accuracy before using it for personal or commercial purposes. Limitation of Liability To the extent permitted by applicable law, Seamless Ventures Pty Ltd and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to these Terms or the use of the Services. In no event shall Seamless Ventures Pty Ltd's total liability exceed the amount paid by you, if any, to Seamless Ventures Pty Ltd for the Services in the twelve (12) months preceding the claim. You have to agree to the terms and conditions of your 3rd-party AI API provider. API Usage Costs and Security (a) API Usage Costs: You are solely responsible for monitoring the usage of your OpenAI API key and any costs associated with your usage of the OpenAI API, including any fees, charges, or expenses incurred. You agree to pay all applicable fees promptly. (b) API Key Security: You are responsible for ensuring the security of your OpenAI API key and for the security of the device you use to access this service. Do not share your API key with any third party, and take measures to protect it from unauthorized access or use. You are fully responsible for any actions taken using your API key. (c) API Key Usage Cap: You are responsible for ensuring you set your max monthly spend in OpenAI API key configurations to no higher than $1 per month. And you agree to regularly monitor your API key usage to ensure it is not being abused. (d) You are responsible for deleting all unused OpenAI API keys related to this service. (e) You are responsible for ensuring you regularly rotate OpenAI API keys (delete old API key, create a new API key just for this service) on a weekly basis to ensure that any compromised API keys cannot be abused. (f) You agree to monitor your OpenAI account associated with this service hourly to manage your usage costs accordingly. In the event you are not happy with any OpenAI usage charges related to this service, you will immediately delete all associated OpenAI API Keys and cease using this service immediately. (g) You agree not to use this service on a public device. You agree to only use this service on a secure device you own. Modifications Seamless Ventures Pty Ltd may update or modify these Terms from time to time. We will provide notice of any material changes. By continuing to use the Services after the changes become effective, you agree to be bound by the revised Terms. These Terms of Use constitute the entire agreement between you and Seamless Ventures Pty Ltd regarding your use of the Services. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
